Out of state remote work policy

The key decision to make sure of is that when making your contracts, be sure to include that compliance is governed by the state regulations in the state which the company is registered, not where the employee lives. This creates legal consistency when working with employees. As always, use this template with a grain of salt and do your legal due diligence before adopting and sharing anything.

Remote Work Policy for Out-of-State Employees

Eligibility

  • All employees who are not based in the company's home state are eligible for this remote work policy.

Expectations

  • All out-of-state employees are expected to maintain regular working hours and be available during the company's core business hours of [Provide time range and time zone, or allow them to work in their time zone].

  • All remote employees are expected to have a dedicated workspace that is free from distractions.

  • Employees are expected to have reliable internet and technology to perform their job duties.

  • Occasional travel may be required to attend off-sites, all-hands meetings and workshops or in-person trainings.

Communication

  • Out-of-state employees are expected to maintain regular communication with their supervisor and team members regardless of time zone.

  • Employees are encouraged to use company-provided communication tools, such as email, instant messaging, and video conferencing.

  • Regular team meetings will be conducted via video conferencing.

Time-off and Absences

  • Out-of-state employees are eligible for the same time-off and absence policies as on-site employees.

  • Employees are expected to provide sufficient notice for planned time off and to make arrangements to ensure coverage of their responsibilities during their absence.

Performance Evaluations

  • Out-of-state employees will be evaluated on their job performance, including their ability to meet job requirements and their contributions to the team.

  • Supervisors will provide regular feedback to employees and conduct an annual performance review.

Compliance

  • Out-of-state employees are expected to comply with all applicable laws and regulations, including those related to telecommuting and remote work.

  • Employees are also expected to comply with the company's Code of Conduct and other policies.

  • The company will provide training and resources as needed to help employees understand and comply with these requirements.
